MBA Libby Trial Conservative Round-up 02-07-07

I am challenged with the insurmountable task of finding conservative bloggers covering the Libby trial, I have spent hours trying to find them and all I can find is one today.

Ok, so I think I should discuss why I think this is the case…

They obviously feel like I feel, the prosecutor is trying to justify hundreds of thousands of tax payer dollars to prosecute a non-crime. Yes, you heard me, a non-crime. Plame was not a covert agent, so there was never a crime. He could have gone to the CIA right from the start and asked her status, which did not fit the criteria for the statute. He could have asked the people who drafted the law if it fit the status, but no, let us not do that or we will be out of a job.

So, what do we have after all this time and money? We have a man on trial for perjury. Provable perjury? I think not, how can you prove to me a persons memory should have been better than it was? This is just plain idiocy and I think this prosecutor should be under investigation. Hopefully after this circus of a trial he will be.

Why you ask? All his witnesses have shown their testimony was inaccurate as well. They had to revue notes and revise their testimony. So, one wonders what is the difference between Libby and all the other flawed Grand Jury Testimony… hmmm?

Look, this is a complete waste of tax payer dollars and everyone’s time. Unless the prosecutor pulls a smoking gun out of nowhere he, like Nifong, should not have pursued this prosecution.

American thinker points out that FBI agent Bond acknowledged that her notes are inaccurate and that the summary of the second interview prepared by her supervisor Eckenrode is substantially at odds with her notes. And goes on that the prosecution has misrepresented Libby’s testimony.

DHS inspector lied to Congress about Ramos and Compean

Congressman John Culberson (R-TX) announced today in Houston, TX that DHS-Inspector General Richard Skinner admitted that his deputy inspectors Lisa Redman and James Taylor as well as DHS congressional liaison Tamara Faulkner LIED to members of Congress about statements that are foundational to the prosecution’s case against Border Patrol agents Compean and Ramos.The DHS inspectors claimed that the Border Patrol agents were “rogue cops” and that they had very damning sworn statements to that effect:

1. They knew that he was unarmed.

2. They knew that he was not a threat to them.

3. That they had said that morning that they were going to “go out and shoot them some Mexicans.”

Furthermore, the DHS officials promised Congress that they would produce those sworn statements for Congressional review. That was four and a half months ago. Since then, DHS has stalled and obfuscated every time the Congressional members wrote letters or made phone calls to collect those statements from DHS.

All three of those statements have now been proven as false. DHS-IG Skinner admitted yesterday that his deputies lied to Congress and that those sworn statements do not exist and that Congress had been “misled”.

Culberson has concluded that DHS deliberately lied to Congress and gave them false information in order to “throw them off the scent” of their investigation into the Border Patrol case. He said this is indicative of a large-scale cover-up inside of DHS, the Department of Justice, and the entire prosecution against Compean and Ramos. He and other Congressman will be announcing today their demand for a full investigation into the DHS cover-up and the immediate resignations of the DHS officials involved.

Criminals Without Borders and the Race card

Illegal Immigration is a problem in this country that overlaps several key issues. Chief among them are National Security and Public Safety. If we can not or will not secure our borders we jeopardize our national security… that however is a topic for a future post.. This one is more about the Criminal aspect of illegal immigration and public safety.

A couple Years ago the GAO did a study about about Illegal Immigrants and Crime.. the results were disturbing and shocking.. Here is a link to the study, fair warning though it is difficult to read…. A fresh pot of coffee is a must.

The GAO study involved a population of 55,322 illegal aliens. They were arrested at least a total of 459,614 times, averaging about eight arrests per illegal alien. Ninety-seven percent had more than one arrest. Thirty-eight percent had two to five arrests; 32 percent had between six and 10 arrests; and 26 percent had more than 11 arrests.

Those 55,000 Prisoners faced nearly 700,000 criminal charges… 45 percent of all offenses were drug or immigration offenses, 15 percent were property-related offenses, 12 percent were for violent offenses such as murder, robbery, assault, and sex-related crimes.

The results of this study make it plainly obvious that in the interest of public safety alone we have got to get a grip on illegal immigration. While not all of the rising crime rates can be attributed to illegal immigrants, the expansion of gangs like MS13, the 18th Street Gang, and the 204th Street Gang clearly show they are a significant factor in those rates.

An article that caught my attention was from the NY Times concerning expanding the national DNA Database. The Database would be expanded under provisions of the 2006 renewal of the Violence Against Women Act. The new forensic DNA sampling was authorized by Congress and permits DNA collecting from anyone under criminal arrest by federal authorities, and also from illegal immigrants detained by federal agents.

Over the last year, the Justice Department has been conducting an internal review and consulting with other agencies to prepare regulations to carry out the law.

The goal, justice officials said, is to make the practice of DNA sampling as routine as fingerprinting for anyone detained by federal agents, including illegal immigrants. Until now, federal authorities have taken DNA samples only from convicted felons.

The law has strong support from crime victims’ organizations and some women’s groups, who say it will help law enforcement identify sexual predators and also detect dangerous criminals among illegal immigrants.

The Times then focuses on the detractors of the policy;

Peter Neufeld, co-director of the Innocence Project, calls the policy “overreaching”, while Immigration Lawyer Deborah Notkin says;

“It’s so broad, it’s scary. It is a terrible thing to do because people are sometimes detained erroneously in the immigration system.”

Of course no criticism would be complete without someone throwing out the race card.

Lisalyn Jacobs, vice president for government relations at Legal Momentum, a law group founded by the National Organization for Women.

“The pervasive problems of profiling in the United States will only be exacerbated by such a system,” Ms. Jacobs said, because Latino and other immigrants will be greatly over-represented in the database. She noted that the law required a court order to remove a profile from the system.

There are racists on both sides of the Illegal immigration Issue, and there are those that accuse the other side of racism in order to marginalize the points that are made. More often than not the Race card is dropped when the logic, common sense, and facts support the conservative position on any particular issue.

Expanding the DNA database will go a long way in enabling Law Enforcement to solve violent crimes, and in bringing closure to cases that have gone cold. Critics of the plan do have one valid point. It will dramatically increase the workload for the FBI Laboratory. Persnoally I think it is well worth the added cost.
